5. collection of general data and information

Our website collects a range of general information each time it is accessed by a data subject or an automated system. This general information is stored in the log files of our web server. The browsers and versions used, the operating system used by the accessing system, the website from which an accessing system accesses our website, the sub-websites that are accessed on our website, the date and time of access to our website, an Internet Protocol address (IP address), the Internet service provider of the accessing system and other similar information that can be used to prevent attacks on our systems can be recorded.

This anonymously collected information is evaluated statistically by Das Erz Medical Spa & Hotel GmbH.

Furthermore, this information is analyzed to increase data protection and data security and to ensure the protection of the personal data processed by us. The anonymous data in the log files is stored separately from the personal data entered by the data subject.

6. registration on our website

The data subject has the option of registering on our website by providing personal data. The personal data that is transmitted to the controller results from the respective input mask that is used for registration. The personal data entered by the data subject is collected and stored solely for the purpose of registration. The controller may arrange for the data to be passed on to one or more processors, who will also use the personal data exclusively for internal purposes. This use is attributable to the controller.

By registering on the website, the IP address assigned by the data subject's internet service provider, the date and the time of registration are stored. The storage of this data serves to prevent the misuse of our services. This data can help to investigate criminal offenses. This data is not passed on to third parties unless there is a legal obligation to pass it on or it serves the purpose of criminal prosecution.

The registration of the data subject with voluntary provision of personal data serves the controller to offer the data subject content or services that are only offered to registered users. A confirmation email is sent to the email address entered by the data subject for the first time for the newsletter mailing in order to check whether the owner of the email address as the data subject has authorized the receipt of the newsletter.

When registering for the newsletter, we also store the IP address assigned by the Internet service provider of the computer system used by the data subject at the time of registration, as well as the date and time of registration. Based on the embedded tracking pixel, the Das Erz Medical Spa & Hotel GmbH may see if and when an e-mail was opened by a data subject, and which links in the e-mail were called up by data subjects.

Such personal data collected via the tracking pixels contained in the newsletters are stored and evaluated by the controller in order to optimize the newsletter dispatch and to adapt the content of future newsletters even better to the interests of the data subject. This personal data is not passed on to third parties. Data subjects are entitled at any time to revoke the separate declaration of consent given in this regard via the double opt-in procedure. After revocation, this personal data will be deleted by the controller. The Das Erz Medical Spa & Hotel GmbH automatically regards a withdrawal from the receipt of the newsletter as a revocation.

If the controller concludes an employment contract with an applicant, the transmitted data will be stored for the purpose of processing the employment relationship in compliance with the statutory provisions. If the controller does not conclude an employment contract with the applicant, the application documents will be automatically deleted two months after notification of the rejection decision, provided that deletion does not conflict with any other legitimate interests of the controller. Other legitimate interest in this sense is, for example, a burden of proof in proceedings under the General Equal Treatment Act (AGG).

15. legal basis of the processing

Art. 6 para. 1 a GDPR serves Das Erz Medical Spa & Hotel GmbH as the legal basis for processing operations for which we obtain consent for a specific processing purpose. If the processing of personal data is necessary for the performance of a contract to which the data subject is party, as is the case, for example, with processing operations necessary for the supply of goods or the provision of any other service or consideration, the processing is based on Art. 6 para. 1 b GDPR. The same applies to such processing operations that are necessary to carry out pre-contractual measures, for example in cases of inquiries about our products or services. If our company is subject to a legal obligation which requires the processing of personal data, such as for the fulfillment of tax obligations, the processing is based on Art. 6 para. 1 c GDPR. In rare cases, the processing of personal data may become necessary in order to protect the vital interests of the data subject or another natural person. This would be the case, for example, if a visitor were injured in our company and their name, age, health insurance data or other information relevant to protection had to be passed on to a doctor, hospital or other third party. The processing would then be based on Art. 6 para. 1 d GDPR. Ultimately, processing operations could be based on Art. 6 para. 1 f GDPR.

Processing operations that are not covered by any of the aforementioned legal bases are based on this legal basis if the processing is necessary for the purposes of the legitimate interests pursued by our company or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject. We are permitted to carry out such processing operations in particular because they have been specifically mentioned by the legislator (Recital 47 Sentence 2 GDPR).

16. legitimate interests in the processing pursued by the controller or a third party

Where the processing of personal data is based on Article 6(1)(f) GDPR, our legitimate interest is to carry out our business activities for the benefit of the well-being of all our employees and our shareholders.

17. duration for which the personal data is stored

The criterion for the duration of the storage of personal data is the respective statutory retention period. After this period has expired, the corresponding data is routinely deleted, provided that it is no longer required for contract fulfillment or contract initiation.

18. legal or contractual provisions for the provision of personal data

We would like to inform you that the provision of personal data is partly required by law (e.g. tax regulations) or may also result from contractual regulations (e.g. information on the contractual partner). Sometimes it may be necessary for a contract to be concluded for a data subject to provide us with personal data that must subsequently be processed by us. In order to conclude a contract, the data subject is obliged to provide us with personal data. If the data subject does not provide their personal data, no contract can be concluded with the data subject. Before the data subject provides personal data, the data subject can contact our data protection officer.

Our data protection officer clarifies to the data subject on a case-by-case basis whether the provision of personal data is required by law or contract or is necessary for the conclusion of the contract, whether there is an obligation to provide the personal data and what the consequences would be if the personal data were not provided.

19. existence of automated decision-making

Our company does not use automated decision-making or profiling.

23 Facebook

Our website uses social plugins (plugins) from the Facebook social network. This service is operated by Facebook Inc (Facebook), 1601 S. California Ave, Palo Alto, CA 94304, USA. The plugins can be recognized by one of the various Facebook logos (white "f" on a blue tile or a "thumbs up" sign) or are marked with the addition "Facebook Social Plugin". The list and appearance of the Facebook social plugins can be viewed here: https://developers.facebook.com/docs/plugins/.

When a user visits a page of our website that contains such a plugin, their browser establishes a direct connection with the Facebook servers. The content of the plugin is transmitted by Facebook directly to your browser, which integrates it into the website. We therefore have no influence on the scope of the data that Facebook collects with the help of this plugin and therefore inform the data subjects according to their level of knowledge:

By integrating the plugins, Facebook receives the information that a user has accessed the corresponding page of the website. If the user is logged in to Facebook, Facebook can assign the visit to their Facebook account. If users interact with the plugins, for example by clicking the Like button or posting a comment, the corresponding information is transmitted directly from your browser to Facebook and stored there. If a user is not a member of Facebook, it is still possible for Facebook to find out their IP address and store it. According to Facebook, only an anonymized IP address is stored in Germany.

The purpose and scope of the data collection and the further processing and use of the data by Facebook, as well as the relevant rights and setting options for protecting the privacy of users, can be found in Facebook's data protection information: https://www.facebook.com/about/privacy/.

If a user is a Facebook member and does not want Facebook to collect data about them via this website and link it to their membership data stored on Facebook, they must log out of Facebook before visiting the website.

Further settings and objections to the use of data for advertising purposes are possible within the Facebook profile settings: https://www.facebook.com/settings?tab=ads or via the website http://www.youronlinechoices.com/. The settings are platform-independent, i.e. they are adopted for all devices, such as desktop computers or mobile devices.
